By Transferring your Florida Real Estate License with ActiveStar Realty LLC. you hereby
acknowledge and agree to the terms of the Agreement.
Fair Housing: ActiveStar Realty LLC. supports and practices Fair Housing principles. All Agents have been advised that failure to comply with Fair Housing principles will result in appropriate disciplinary action and possible termination. All Agents are to attend Fair Housing instructional programs, keep current on developments in Fair Housing as it affects real estate marketing and sales, and comply with all Fair Housing laws and regulations.
Licensing: All Agents/Independent Contractors are required to meet and maintain all Florida state licensing requirements. Broker has no responsibility or obligation regarding Agents Licenses, fees or renewal status. Agent is required to email copy of license to [email protected] or mail it the contact address.
Agents Contact Information: Agent agrees to maintain up to date records and contract information with the Broker, and the State of Florida
Compensation: Agent is NOT to receive any commission/money directly. All commission would be directed to and received by ActiveStar Realty LLC. , then disbursed to Agent after Agent completes a IRS W9. and provides any paperwork needed by Broker. Agent will receive 90% of any 25% referral fee collected and 90% of any co-op agreed to be paid by other brokerage and collected (IE Agent purchase of own property) Broker is to receive full commission of any transaction unless Broker Agrees in writing otherwise. Agent agrees all Broker commission will be on HUD1 Agent can't reduce commission without Brokers written agreement to do so.. Agents commission can be applied towards purchase/closing cost if Brokers agrees with authorized letter. (Agent should consult with Accountant/CPA) Broker will not co-operate with any "COMMISSION ADVANCE" service
Advertising Materials: Contractors are responsible for all of their own advertising expenses (i.e. Business Cards) All advertising materials must be submitted to the broker for approval prior to use. Submitting proofs prior to final printing or purchase is strongly recommended to save the Independent Contractor money for unnecessary mistakes or issues. For legal purposes, and to maintain a professional image, marketing materials used without prior management approval can cause the Independent Contractor to be fined, suspended or terminated.
Escrow Funds: ActiveStar Realty LLC. does NOT provide trust services for Real Estate Transaction sales. All Escrow/Deposit checks must be made payable to the escrow account of a licensed title company or in the trust account of a Florida licensed Attorney at Law.
Fee Schedule: Agents annual fee is due yearly. Non payment would result in termination and change of license status.
Outside Accounts: Agents are NOT allowed to establish any outside accounts in the company’s name and
if done will be grounds for termination.
Independent Contractor Standing: All licensed Real Estate Professionals connected to ActiveStar Realty LLC. are considered Independent Contractors. Independent Contractor is responsible for paying his/her own estimated income tax payments, self-employment taxes, occupational taxes and other taxes, if any to the appropriate Governmental entities. Broker will not withhold any taxes from compensation due to Independent Contractor, nor will Broker provide any worker’s compensation insurance.
Insurance: Errors and Omission and Liability Insurance is not covered by Brokerage. If Agent needs such insurance than Agent shall have to secure and pay for such insurances without Brokers help.
Facilities: Agent shall rely solely on the Agents own resources. Broker maintains facilities required by Chapter 475.
Indemnification: Agent hereby acknowledges and agrees to hold Broker, directors, employees and associates harmless from all claims, cost, expenses, lawsuits including all fees. This includes but is not limited to acts of negligence, misrepresentation, misconduct, violation of any law, rule, code, local, state or federal.
Do Not Call Policy: Agent must comply with all Do Not Call National and State guidelines. Specifically, the Agent is responsible for NOT calling any consumer who has placed their number on the Do Not Call List. The Agent is held accountable for failing to follow the policy and will be responsible for paying any fines and associated costs. Termination: This agreement Terminates automatically if Agents License status changes, or Agent moves to another Brokerage. No refund would be given for any form of termination. Agreement stays in force and Agents license stays Active as long as the DBPR does not change it (IE education missing etc) and yearly payment to Broker is made.
